Does BB really want to go down this road. Its pretty clear from the poor design that they have little standing.
BTW last year I posted issues with a friends new coach that had a huge lithium system. Well, he sent the coach back to the manufacturer, they spent six months fixing all the issues and he has moved on so they can keep it. But I bring it up because the coach has BB batteries.
Its funny as I peruse FB marketplace there are an inordinate amount of lithium batteries for sale and only one brand, BB

They are trying to save face and make Will the scapegoat for calling them out. He will shred them in court. And they will have to admit that the "safety feature" they built in destroys the battery, and they didn't tell anyone. He documented using the battery exactly by their standards and it failed.....that will be interesting.

These outfits have deep pockets. Litigation is an intimidation strategy. The makers of Prevagen, a snake oil sugar pill which mostly boomers buy to enhance their memory have sued numerous different neurologists who have exposed Prevagen as a con. If Prowse doesn't have the resources to defend himself he'll have to settle and part of that settlement would be that he goes dark, which is the object.
